1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you") and Kushtia Smart Tutor ("Platform", "we", "us", "our"). By accessing, registering on, or otherwise using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy in full. If you do not agree to any part of these Terms, you must immediately discontinue use of the Platform.

2. Eligibility

You must be at least 18 years of age, or the age of majority in your jurisdiction, to independently create an account. Users under 18 may use the Platform to search for or engage a tutor only under the direct supervision and account of a parent or legal guardian, who assumes full responsibility for such use.

3. Nature of the Service

Kushtia Smart Tutor operates solely as an intermediary matching platform connecting independent home tutors ("Tutors") with students and guardians ("Students/Guardians") seeking tutoring services. We do not employ Tutors, and Tutors are not agents, employees, or representatives of the Platform. Any tutoring arrangement, agreement on fees, schedule, or manner of instruction is made directly and independently between the Tutor and the Student/Guardian, and the Platform is not a party to that arrangement.

4. Accounts & Security

• You must provide accurate, current, and complete information during registration and keep it updated.
• You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• You must notify us immediately at the contact address below of any unauthorized use of your account or any other breach of security.
• We reserve the right to verify any information provided and to refuse or revoke registration where information is found to be false, misleading, or incomplete.

5. Tutor Verification, Listings & Fees

Tutor applications submitted through the Platform are reviewed by our administrative team before a Tutor's profile ("Ad") is published live. We reserve full discretion to approve, reject, suspend, or remove any Tutor listing at any time, with or without stated cause, in order to maintain the quality and safety of the Platform.

5.1 Activation Fee

To activate and publish a listing, a Tutor may be required to pay a listing activation fee via the manual bKash/Nagad "Send Money" process described on the Platform, using the unique reference ID assigned to their account. Payments are verified manually by our administrative team before an account status is updated.

By using the Platform, you agree that you will not:

• Provide false, misleading, or fraudulent information, including regarding academic qualifications or identity;
• Use the Platform for any unlawful, harassing, abusive, discriminatory, or exploitative purpose, including toward minors;
• Attempt to circumvent, disable, or interfere with the security or proper functioning of the Platform;
• Scrape, copy, or redistribute Platform content or user data without authorization;
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

Violation of this Code of Conduct may result in immediate suspension or termination of your account without refund, and, where applicable, referral to law enforcement authorities.

7. Limitation of Liability

The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, Kushtia Smart Tutor disclaims all warranties, express or implied, regarding the Platform and the conduct, qualifications, or performance of any Tutor or Student/Guardian. We are not responsible for, and shall not be liable for, any dispute, financial loss, personal injury, property damage, or other harm arising from or related to interactions, arrangements, or transactions between Users conducted outside or in connection with the Platform. Our aggregate liability for any claim arising out of or relating to your use of the Platform shall not exceed the total amount, if any, paid by you to the Platform in the twelve (12) months preceding the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless Kushtia Smart Tutor, its administrators, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Platform, your violation of these Terms, or your interaction with any other User.

9. Suspension & Termination

We reserve the right, at our sole discretion and without prior notice, to suspend or terminate your access to the Platform, remove any listing, or delete any account that we reasonably believe violates these Terms, poses a risk to other Users, or is otherwise harmful to the integrity of the Platform.

10. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of Bangladesh, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Platform shall first be attempted to be resolved amicably through good-faith negotiation between the parties before pursuing any other remedy available under applicable law.

11. Changes to These Terms

We may revise these Terms at any time. Material changes will be indicated by an updated "Last updated" date at the top of this page and, where appropriate, communicated via notice on the Platform. Continued use of the Platform following any such change constitutes your acceptance of the revised Terms.

12. Privacy Policy — Introduction

This Privacy Policy explains how Kushtia Smart Tutor collects, uses, discloses, and safeguards information when you use the Platform. By using the Platform, you consent to the data practices described in this policy.

13. Information We Collect

• Account information: full name, phone number, email address, and a securely hashed password.
• Tutor-specific information: academic qualifications, subjects taught, preferred teaching area, and a profile photograph.
• Payment confirmation details: sender mobile number, transaction reference ID, and amount submitted for manual verification of the listing activation fee. We do not collect or store full financial account credentials.
• Usage information: basic technical information such as timestamps of account activity, stored to help secure and operate the Platform.

14. How We Use Information

• To create and manage your account and verify Tutor applications;
• To connect Students/Guardians with suitable Tutors;
• To process and manually verify listing activation payments and refunds;
• To communicate important updates, security alerts, and administrative messages;
• To maintain the safety, security, and integrity of the Platform, and to investigate suspected violations of these Terms.

15. Disclosure of Information

We do not sell your personal information to any third party. Information may be disclosed only: (a) to trusted service providers strictly necessary to operate the Platform (such as our email delivery and cloud hosting providers), bound by confidentiality obligations; (b) where required to comply with a valid legal process, court order, or government request; or (c) to protect the rights, safety, or property of the Platform, our Users, or the public.

16. Data Security & Retention

We apply reasonable technical and organizational safeguards, including password hashing and access-controlled infrastructure, to protect your information against unauthorized access, alteration, or disclosure. However, no method of electronic storage or transmission is completely secure, and we cannot guarantee absolute security. We retain personal information for as long as your account remains active, or as necessary to comply with legal obligations, resolve disputes, and enforce our agreements, after which it will be securely deleted or anonymized.

17. Your Rights

You may request access to, correction of, or deletion of your personal information held by us at any time by contacting us at the email address below. We will respond to verified requests within a reasonable timeframe, subject to any legal obligations that require us to retain certain information.

18. Children's Privacy

The Platform is not directed at children under 18 acting independently. We do not knowingly collect personal information directly from children under 18 without the involvement of a parent or legal guardian. If we become aware that we have inadvertently collected such information without appropriate consent, we will take steps to delete it promptly.
